Terms of Use and Data Privacy
These Terms of Use and Privacy & Data Use Policy (collectively, these “Terms”) govern your access to and use of our conversational research and insights platform, including the design, deployment, and analysis of conversational surveys (the “Service”).
By creating an account, signing in, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
Terms of Use
1. Description of Service
Our Service provides tools to:

Design conversational surveys and interview flows

Deploy conversational data collection experiences

Analyze conversational data through visual and interactive analytics
The Service is intended for organizational research, strategic insights, and related internal business purposes.
We may update or modify the Service from time to time, including adding, changing, or removing features.
2. Eligibility & Accounts
To use the Service, you must:

Be at least 18 years old.

Have the authority to enter into these Terms, whether on your own behalf or as an authorized representative of an organization.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You agree to promptly notify us of any unauthorized use of your account.
3. Acceptable Use
You agree that you will not:

Use the Service in violation of any applicable law or regulation.

Use the Service to collect, upload, or process:
-
Sensitive personal data (e.g., health/medical information, financial account numbers, government IDs, precise geolocation, or information about minors), or
-
Confidential or material nonpublic information.
We do not request and ask that you do not provide such data through the Service.

Attempt to probe, scan, or test the vulnerability of any system or network or breach any security or authentication measures.

Interfere with or disrupt the Service or servers or networks connected to the Service.

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service, except as permitted by law.
We reserve the right to suspend or terminate access to the Service for violations of these Terms.
4. Intellectual Property
All rights, title, and interest in and to the Service (including software, documentation, logos, and trademarks) are owned by Blendification LLC or our licensors and are protected by intellectual property laws.
Customer Content.
You retain all rights to the content and data you or your organization submit to the Service, including conversational responses, uploaded materials, and derived datasets specific to your organization (“Customer Content”).
You grant us a non-exclusive, worldwide, royalty-free license to host, process, and use Customer Content solely to:

Provide, maintain, and improve the Service

Secure and protect the Service
-
Comply with applicable law
We do not claim ownership of Customer Content.
5. Third-Party Services & AI Providers
The Service may rely on third-party infrastructure and AI model providers, such as:

Cloud hosting and databases (e.g., AWS, including Amazon Cognito and DynamoDB)
-
Large language model providers (e.g., OpenAI, Groq, AWS Bedrock or similar)
We use these providers to process conversational data and generate insights. We contractually require that such providers maintain appropriate security and confidentiality protections.
Where required, your use of certain features may also be subject to the third-party provider’s terms and privacy policies. We are not responsible for third-party services we do not control.
6. Fees & Payment (if applicable to self-service users)
If your web app has only enterprise access and not self-serve billing, you can delete or simplify this.
If you purchase paid features or subscriptions, you agree to pay the applicable fees described at the time of purchase. Unless otherwise stated, fees are:

Billed in advance, and
-
Non-refundable, except as required by law.
We may change pricing and plans with reasonable notice to you.
7. Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:

The Service will be uninterrupted, secure, or error-free; or
-
The insights, analytics, or outputs produced by the Service will be accurate, complete, or suitable for any particular decision-making purpose.
You are responsible for evaluating and using the outputs of the Service within your own professional judgment and context.
8. Limitation of Liability
To the maximum extent permitted by law:

We will not be liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, revenue, or data, arising out of or related to your use of the Service.

Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you actually paid us for use of the Service in the three (3) months preceding the claim, or (b) USD $100.
Some jurisdictions do not allow limitations of certain liabilities, so parts of this section may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless Blendification LLC, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Service,

Your violation of these Terms, or
-
Your violation of any rights of another person or entity.
10. Changes to the Service & Terms
We may update or change the Service or these Terms from time to time. When we make material changes, we will update the “Last updated” date and may provide additional notice (e.g., in-app notice or email).
If you continue to use the Service after the updated Terms become effective, you agree to be bound by the updated Terms.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of Colorado, without regard to its conflicts of laws principles.
Any disputes arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Colorado, and you and we consent to the personal jurisdiction of those courts.
Privacy & Data Use Policy
1. Overview
This Privacy & Data Use Policy explains how we collect, use, store, and share information when you use the Service.
We are committed to:

Collecting minimal identifying information;

Securing data through appropriate technical and organizational measures;

Not using your data for marketing or solicitation; and
-
Not using your data for training our underlying machine learning models.
2. Information We Collect
Account Information.
When you sign up or are invited to the Service, we collect:

We do not intentionally collect other personally identifying information and instruct users not to enter sensitive personal data.
Conversational & Usage Data.
When you or your participants use the Service, we may process:

Conversational survey content and responses

Interview transcripts and associated metadata

Usage data such as timestamps, event logs, and technical information (e.g., browser type, IP address truncated or pseudonymized where feasible)
We treat conversational data as Customer Content under the Terms of Use.
3. How We Use Data
We use data to:

Provide and operate the Service

Hosting, authentication (e.g., AWS Cognito), access control

Processing conversational data to generate analytic outputs

Maintain security and reliability

Monitoring for abuse, misuse, and technical issues

Protecting against unauthorized access

Improve the Service

We may analyze deidentified or aggregated data to understand performance and usage patterns and to improve our products and features.

Research & Market Studies (Deidentified/Aggregated)

We may use deidentified and/or aggregated information for market studies, benchmarking, case studies, or to publish non-sensitive insights in the public domain (e.g., industry trend reports).

When doing so, we will not identify your organization or individual users by name without your explicit consent.

We do not:

Use your identifiable data for marketing or solicitation.

Use your Customer Content to train base AI models (e.g., foundation LLMs) provided by third parties. If we fine-tune internal models, we will only do so using anonymized or aggregated content or with your agreement.
4. Data Storage, Security & Retention
Storage & Segregation.

Data is stored in cloud infrastructure (e.g., AWS) such as DynamoDB and S3.
-
Records are segregated via indexing, meaning they are associated with organization IDs and/or user IDs to logically separate customers’ data.
Security.
We implement reasonable and appropriate safeguards, including:

Authentication and access control (e.g., AWS Cognito)
-
Encryption in transit (e.g., HTTPS/TLS)
-
Role-based access control for internal personnel
No method of transmission or storage is 100% secure, but we work to protect your information.
Retention.
We retain data for as long as necessary to:

Provide the Service to you,

Comply with legal obligations, or
-
Resolve disputes.
We may implement automated deletion or archival processes (e.g., removal of certain logs or transient data after a defined period). You may request deletion of certain data as described below.
5. Data Sharing & Disclosure
We do not sell your personal information.
We may share data in these limited circumstances:

Service Providers & Subprocessors.
With third-party vendors who help us operate the Service (e.g., hosting, database, logging, email, AI/LLM providers). They are bound by contractual obligations to protect your data and use it only for the services they provide. -
Deidentified / Aggregated Data.
We may share or publish deidentified or aggregated information (for example, general statistics or trend analyses) that does not identify any individual or organization. -
Legal & Safety.
If required by law or valid legal process, or to protect the rights, safety, or property of us, our users, or others. -
Business Transfers.
In connection with a merger, acquisition, or sale of all or part of our business, subject to standard confidentiality protections.
6. Data Subject Rights
Depending on your location and applicable law (e.g., GDPR, CCPA), you may have rights regarding your personal data, including:
Access to the personal data we hold about you
Correction or update of your personal data
Request deletion of your personal data
Object to or restrict certain processing
Data portability in some cases
For requests, contact us at admin@blendification.com. We may need to verify your identity before acting on a request and may not be able to fully respond where we have overriding legitimate grounds or legal obligations.
For data that we process on behalf of an enterprise customer, we may redirect you to that customer, who is typically the data controller for participant data.
7. Children & Sensitive Data
The Service is not intended for children under 18, and we do not knowingly collect personal data from children.
We do not seek and instruct users not to provide sensitive personal data (e.g., health, financial, government IDs, precise geolocation, or any data that is confidential and material).
If you believe we have collected such data inadvertently, please contact us and we will work to delete or appropriately handle it.

We may update this Privacy & Data Use Policy from time to time. When we make material changes, we will update the “Last updated” date and may provide additional notice (such as via email or in-app notification).
